The Hind Rajab Foundation said on Monday that it had sent an urgent request to the US Department of Justice, asking for the investigation, arrest and prosecution of Sean Glass, an Israeli military commander it accuses of war crimes and genocide in Gaza. According to Roya News, the organization says Glass is currently in the United States, and its statement is dated October 19.

Hind Rajab Foundation Files Urgent Request

The foundation says Glass commanded the Vampire Empire Company of the 52nd Armored Battalion, part of the 401st Armored Brigade. Roya News reported that the group wants US authorities to pursue the case under federal laws covering war crimes and genocide.

The alleged offences include unlawful killings, torture, inhuman treatment, unlawful transfer and the extensive destruction of property without military necessity. In its published statement, the foundation said Glass had been implicated in the killing of five year old Hind Rajab, her relatives and the medics sent to help them. Middle East Eye quoted the group as saying, “Today, Glass walks free in the U.S.”

The Killing of Hind Rajab in Gaza

Al Jazeera reported that Hind and her family were trying to leave Gaza City on January 29, 2024, when their vehicle came under Israeli fire. Her relatives were killed, and she phoned emergency services to ask for help. Roya News said two Palestinian Red Crescent medics sent to rescue her were also killed.

Al Jazeera reported that the car had 335 bullet holes. It said Israeli authorities first blamed a firefight with Palestinian fighters. The group Forensic Architecture found no sign of an exchange of fire and concluded that only Israeli forces were in the area, according to Al Jazeera. Ozarab Media, citing Al Jazeera, reported that Israel has opened a probe into the killings.

Evidence Cited Against Sean Glass

Roya News reported that the foundation’s investigation found the 52nd Battalion was the only Israeli armored unit operating nearby. It says the Vampire Empire Company was a few hundred metres from the family’s vehicle for the whole period of the killings.

The foundation says Glass most likely gave the order to open fire. Its head of litigation, Natacha Bracq, told Roya News the case draws on geolocated imagery, forensic analysis and public statements by Glass. Al Quds reported that the file also uses images and material Glass posted on social media. The allegations about his individual responsibility have not been adjudicated by a court.

Rashida Tlaib Calls for Arrest

Al Jazeera reported that US Representative Rashida Tlaib shared the foundation’s report and urged the government to act. She wrote that the US, as a party to the Genocide Convention and the Geneva Conventions, is “obligated to arrest and investigate him.”

Will the US Department of Justice Open an Investigation?

The coverage reviewed by Tamrah News did not include a public response from the US Department of Justice. It is not yet known whether federal prosecutors will take up the request. Tamrah News also did not find a public reply from Glass.

Wider Legal Action Over Hind Rajab

The foundation says it has already filed a submission about Glass and other soldiers with the International Criminal Court. It says it has also lodged criminal complaints in other jurisdictions, including the United States. In a January statement marking the second anniversary of the killing, the group said it had identified 24 people it holds responsible.

This report on the Hind Rajab Foundation request will be updated as the US Department of Justice or Sean Glass responds.
